These Terms of Service ("Terms" or "Agreement") govern your access to and use of our website, mobile applications, and services provided through our three divisions — Business Consulting Services, Project Management Training, and BMT Apparel. By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. Acceptance of Terms

By accessing this website or purchasing any of our services, you confirm that you are at least 18 years of age and are legally able to enter into binding contracts. If you are accessing our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

BMT Consulting LLC provides services through three divisions:

• Business Consulting Services: Business/Organizational Setup, automation, AI integration, CRM architecture, fractional CAO advisory, and strategic growth consulting.
• Project Management Training: Instructor-led exam prep courses (PMP, CAPM, PMI-ACP), self-paced study tools, study apps, and online coaching through our RMC Authorized Training Partner curriculum.
• BMT Apparel: Premium executive corporate apparel, branded polos, outerwear, hats, and custom team merchandise.

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of our services.

3. Accounts and Registration

To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Intellectual Property Rights

All content on this website, including text, graphics, logos, images, course materials, software, and the overall look and feel of the site, is the property of BMT Consulting LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

Course materials, study guides, practice exams, and training content provided through our Project Management Training division are licensed for your personal, non-commercial use only. Sharing, redistributing, or reselling these materials is strictly prohibited.

5. Acceptable Use Policy

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of our website, systems, or data
• Interfere with or disrupt the operation of our website or servers
• Upload or transmit viruses, malware, or any other malicious code
• Scrape, copy, or harvest content from our website without permission
• Impersonate another person or misrepresent your affiliation

6. Consulting and Training Engagements

6.1 Consulting Services

Business consulting engagements are governed by a separate Statement of Work or Service Agreement that will be provided before any engagement begins. In the event of a conflict between these Terms and a signed Service Agreement, the terms of the Service Agreement shall prevail.

6.2 Training and Certification Courses

While our training programs are designed to prepare you for certification exams, we do not guarantee that you will pass any certification exam. Certification exam requirements are set and controlled by third-party organizations, including the Project Management Institute (PMI). Course fees do not include certification exam fees, which are paid directly to the certifying body.

6.3 Refund Policy — Training Courses

Refund eligibility for training courses is determined by the specific course terms provided at the time of purchase. Generally, cancellations made at least 14 days before the course start date may be eligible for a full refund less a processing fee. Cancellations within 14 days may be eligible for credit toward a future course. No refunds are provided after a course has begun or for self-paced digital products once access has been granted.

7. Apparel Orders

7.1 Orders and Payment

All apparel orders are subject to availability and confirmation of the order price. We reserve the right to refuse or cancel any order at our discretion. Payment must be received in full before orders are processed and shipped.

7.2 Shipping and Delivery

Estimated delivery times are provided as guidelines only. We are not liable for delays caused by shipping carriers or circumstances beyond our control. Risk of loss passes to you upon delivery to the shipping carrier.

7.3 Returns and Exchanges

Apparel and merchandise orders are made to order and are governed by our Return & Refund Policy.

8. SMS and Text Messaging Terms

By opting in to receive SMS messages from BMT Consulting LLC, you agree to receive transactional and marketing text messages related to our services at the phone number you provided. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying "STOP" to any message. For help, reply "HELP." Carriers are not liable for delayed or undelivered messages. By opting in, you confirm that you are the owner or authorized user of the phone number provided.

Our website may contain links to third-party websites and may integrate with third-party services. We do not control and are not responsible for the content, policies, or practices of third-party sites or services. 11. Limitation of Liability

To the fullest extent permitted by applicable law, BMT Consulting LLC and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use our website or services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us for the specific service giving rise to the claim, or one hundred dollars ($100), whichever is greater.

You agree to indemnify, defend, and hold harmless BMT Consulting LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from your violation of these Terms, your use of our services, or your infringement of any rights of a third party.

15. Class Action Waiver

You agree that any arbitration or legal proceedings shall be limited to the dispute between you and BMT Consulting LLC individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other, and there shall be no class or consolidated arbitration or proceedings.

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.

17. Severability
